1. THE MARKETPLACE MODEL
Commonplace, Inc. ("Commonplace") operates a technology platform and logistics network connecting independent Buyers and Sellers of used home goods and fitness equipment.
- "As-Is" Sales: All items are used and sold "As-Is." Commonplace does not own the inventory, but every purchase includes a free 2-month (60-day) parts warranty, and Commonplace covers any damage that occurs in transit.
- Buyer Acknowledgment at Checkout: By placing your order, you acknowledge and agree that the item is used, that you have had the opportunity to review all listing photos and the item description, and that you agree to take delivery of the item once you approve the pre-pickup inspection - the 6+ photos and functionality video our team captures at the Seller's location and sends to you before the item is transported. Once you approve the pre-pickup inspection, the sale is final, except where the item is damaged in transit or the live check at handoff finds something that does not match the approved packet.
- The $1 Reservation: To promote serious transactions, Buyers pay a $1 fee at checkout to hold an item and take it off the market. If the inspection fails, the Buyer declines the packet, or the order is otherwise cancelled before approval, the $1 hold is released and nothing further is owed.
2. LOGISTICS & CANCELLATION
2.1 Delivery Fees & Distance
Commonplace calculates delivery fees from a per-category Base Fee plus a per-mile rate that depends on the item's category, applied only to the miles beyond the free 100. The exact total is computed from the item's real location and displayed at checkout; we do not publish a single flat per-mile rate.
- Free within 100 miles: Delivery is free within 100 miles of the item.
- Delivery Radius: Non-vehicle items deliver up to 1,500 miles from where the item sits; drivable vehicles (cars, golf carts, jet skis, and the like) have no distance cap. Beyond the radius an item is not deliverable, and the listing will say so for your address.
2.2 Pickup Documentation & "Point of No Return"
At pickup, our drivers record 6+ photos and a functionality video. This documentation is sent to the Buyer immediately via text/email.
- Buyer Approval: The Buyer reviews this pre-pickup inspection; by approving it, the Buyer confirms the item matches the listing and agrees to take delivery. Delivery proceeds once the Buyer approves.
- Cancellation Before Approval: A Buyer may cancel any time before approving the pre-pickup inspection. The $1 hold is released and nothing further is owed.
- After Approval: Once the Buyer approves the pre-pickup inspection, the sale is final. It can still be cancelled at no charge if the item is damaged in transit, or if the live check at handoff finds something new that does not match the approved packet - in which case we help the Buyer find a better option. There is no refuse-at-the-door return and no home trial.
2.3 White-Glove Delivery Standards
Our "Move and Place" service includes:
- Included: Carry-in (including stairs), room placement, assembly, leveling, and WiFi setup.
- Excluded: No electrical or plumbing. Commonplace will not perform hard-wiring or plumbing for Hot Tubs or Saunas. Buyers must hire licensed professionals for these connections.
3. PAYMENTS, DISBURSEMENTS, & RISK ALLOCATION
3.1 Buyer Payment
For orders under $8,000, the remaining balance (Item + Delivery + Tax) is authorized at checkout and due on delivery. For orders of $8,000 or more, the balance is paid by wire when the Buyer approves the pre-pickup inspection, never by automatic card charge.
3.2 Seller Payout (Paid at Pickup)
Sellers are paid immediately upon the delivery team successfully picking up the item.
- Timing: Payout is initiated once the item is loaded and the Bill of Sale is signed.
- Methods: Venmo/PayPal (Same-day); Bank Transfer/Cash App (1–3 business days).
- Deductions: Platform Fees (15–25%) and Pickup Fees ($50–$400) are deducted automatically.
3.2.1 Pickup Inspection Requirements
Drivers have the sole authority to refuse a pickup if the item fails the following:
- Listing Match: Item must match the brand/model/color described.
- Functionality: Item must power on and demonstrate core functions.
- Components: All advertised accessories must be present.
- Refusal Consequences: Sale is canceled, Buyer is refunded.
3.2.2 Payment Clawback & Seller Liability
Commonplace reserves the right to claw back funds (via future payout deduction, reversal, or legal collection) for:
- Seller Fault: Proven fraud or material misrepresentation.
- Inspection Mismatch: A sale cancelled because the live check at handoff found the item did not match the approved pre-pickup packet.
- Fraud/Theft: Items identified as stolen, counterfeit, or under active recall.
3.2.3 Seller Representations & Warranties
By listing, the Seller warrants:
- Ownership: You are the legal owner with the right to sell.
- Accuracy: Your listing is 100% truthful.
- Legal Compliance: The item is not stolen or subject to a lien.
- Breach: Results in immediate payment reversal and potential criminal referral.
3.2.4 Seller Indemnification
Seller agrees to indemnify Commonplace from all third-party claims, including chargebacks due to Seller fraud, stolen property claims, or personal injury caused by undisclosed defects.
3.3 Buyer Chargeback Policy & Account Consequences
- Mandatory Resolution: Buyers must contact service@trycommonplace.com and allow 5 business days for resolution before filing a bank dispute.
- Permitted vs. Prohibited:
- ✓ Permitted: A cancellation owed for transit damage or an inspection mismatch that was wrongly refused; duplicate billing.
- ✗ Prohibited: Buyer's remorse after approving the pre-pickup inspection; issues disclosed in the listing; cosmetic wear consistent with a used item.
- Consequences:
- Level 1: If Commonplace wins a dispute, the Buyer is assessed a $25 Dispute Fee.
- Level 2: Permanent account ban and entry into the "High-Risk Fraud Database."
- Level 3: Reporting to the IC3 (FBI) and consumer reporting agencies.
4. FINAL SALE, TRANSIT DAMAGE & WARRANTY
The sale is final once you approve the pre-pickup inspection. There is no refuse-at-the-door return, no home trial, and no post-delivery "change of mind" window - because you approve the item's real condition (6+ photos and a functionality video) before it ever leaves the Seller.
- Before you approve: If the inspection fails or you decline the packet, you owe nothing beyond the $1 hold, which is released.
- Damage in transit: If the item is damaged between pickup and delivery, that is on us - we cancel at no charge and help you find a better option, or make it right.
- Inspection mismatch at handoff: If the live check at handoff finds something new that does not match the packet you approved, we cancel at no charge and help you find a better option.
- Free 2-month warranty: Every purchase includes a free 2-month (60-day) parts warranty; repair labor is not included. Optional extended coverage can be purchased separately and is never required. A month-to-month parts plan is added to your cart automatically at no charge on the day of purchase - billing begins only when the free 2-month window ends, and you may remove it before checkout or cancel it at any time. An optional parts and labor plan is also offered; it replaces the parts plan, begins billing on the order date, and does not carry the free 2-month window. If you buy a prepaid 6, 12 or 18-month plan, "continue month to month after the term" is selected by default: when the term ends, cover continues at the monthly rate shown beside that option until you cancel. You can untick it before checkout, and you can cancel at any time afterwards from your order page.

5. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Commonplace's total liability arising out of any transaction is limited to the amount paid by the Buyer for the item and its delivery. Commonplace is not liable for indirect, incidental, or consequential damages.
6. GOVERNING LAW & UPDATES
These Terms are governed by the laws of the United States and the state in which Commonplace, Inc. is incorporated. We may update these Terms from time to time; continued use of the platform constitutes acceptance of the current Terms. Questions? Contact service@trycommonplace.com.
